1. About us

1.1

"Evercraft", "we", "us" and "our" mean Furnitech Innovators Private Limited, CIN [CIN], GSTIN 08AAFCF2489N1Z0. The registered office is at Boranada Industrial Area, Phase 4, Opp. Suncity Metals & Tubes Pvt. Ltd., Boranada, Jodhpur – 342012, Rajasthan.

1.2

"You" means any person who uses the website or buys from us. "Products" means furniture, modular interiors and related goods and services we sell.

1.3

These Terms are an electronic record under the Information Technology Act, 2000 and need no physical or digital signature.

2. Eligibility

2.1

You must be 18 or older and able to enter a binding contract under the Indian Contract Act, 1872. If you buy on behalf of a company, you confirm that you are authorised to do so.

2.2

Website purchases are for personal and household use. We may limit quantities per order or per customer. Bulk, institutional, project, office and other commercial orders are business transactions, not consumer purchases. They are governed by the written quotation or purchase order, by these Terms wherever that document is silent, and by the Indian Contract Act, 1872. Disputes arising from them are subject to the exclusive jurisdiction of the courts at Jodhpur, Rajasthan.

3. How an order becomes a contract

3.1

Products shown on the website are an invitation to make an offer. When you place an order and pay, you make an offer to buy.

3.2

The automatic acknowledgement you receive after checkout only confirms that we received your order. The contract is formed when we send a written Order Confirmation by email, SMS or WhatsApp. For custom and interior orders, the contract is formed when you also sign off the final specification or design.

3.3

We may decline any order before sending the Order Confirmation. Reasons include stock unavailability, a pricing or listing error, an unserviceable delivery location, or suspected fraud. Any amount you paid is then refunded in full. Except where the law requires otherwise, we are not liable for any indirect or consequential loss arising from our inability to accept the order.

4. Payment

4.1

Every order is 100% prepaid. We start production or dispatch only after the full amount is received in our account. Details are in the Billing, Payment & EMI section.

5. Product availability

5.1

Availability is shown on each product page. Beyond that, we cannot be more specific about stock. Delivery and dispatch dates are estimates, not guarantees.

5.2

If a Product turns out to be unavailable after you order, we will tell you by email, SMS or WhatsApp. You can then choose an alternative or receive a full refund.

6. Pricing and errors

6.1

Prices are in Indian Rupees and include GST unless stated otherwise. Delivery, installation and handling charges, if any, are shown separately before you pay.

6.2

A product in your cart does not reserve its price. The price charged is the one shown when you place the order.

6.3

Despite our checks, a price or specification may be listed incorrectly. If we find an error before dispatch, we will contact you. You can then pay the correct price or cancel for a full refund. Any coupon, discount or offer calculated on a clearly wrong price may be withdrawn.

6.4

Where we show a discounted price, the earlier price shown alongside it is the lowest price at which the product was offered on our website in the preceding 30 days.

7. Product descriptions and natural materials

7.1

Much of our furniture is hand-finished from wood, veneer, stone, leather and fabric. Variations in grain, texture, shade and finish are natural characteristics, not defects.

7.2

Dimensions shown for loose furniture are approximate and may vary slightly due to manufacturing, upholstery, construction and finishing tolerances. For modular and interior work, the dimensions in the signed drawings apply.

7.3

Colours in photos and videos can look different on screens and under different lighting. Props and décor shown are not included unless the listing says so. Please check the specifications, sizes and finish samples before ordering. You are responsible for choosing a Product suitable for your space and purpose.

7.4

Unless the product page states otherwise, all Evercraft products are made in India and are manufactured by or for Furnitech Innovators Private Limited, Boranada Industrial Area, Phase 4, Jodhpur – 342012.

8. Custom and made-to-order products

8.1

Custom and made-to-order Products are made to the specification you approve in writing. Once production starts, the specification cannot be changed. Please check measurements, sizes, finishes and fabrics carefully before approving. Approving a specification does not waive your rights for manufacturing defects, wrong supply or failure to follow the approved specification.

8.2

If you supply measurements or designs, you are responsible for their accuracy.

9. Your account and communications

9.1

You are responsible for keeping your login and OTP private, and for all activity on your account.

9.2

By giving us your phone number and email, you agree that we may contact you by call, SMS, email and WhatsApp about orders, deliveries and service. Promotional messages are sent only with your consent, and you can opt out at any time.

10. Acceptable use

You agree not to:

• give false information or use someone else's identity or payment method,
• copy, scrape or reuse website content, prices or listings, or use bots or data-mining tools,
• interfere with, hack or test the security of the website,
• upload anything unlawful, defamatory, infringing or harmful, or containing viruses,
• misuse offers, referral codes or gift cards, or open multiple accounts to do so, or
• post false or malicious reviews.

If you breach these Terms, we may suspend your account, cancel pending orders (with a refund of amounts paid for undelivered Products), and take legal action. We may also recover losses caused by fraud.

11. Intellectual property

Evercraft, Evercraft India, our logos, product designs, drawings, 3D renders, photos, videos and all website content belong to Furnitech Innovators Private Limited or its licensors. They may not be copied, reproduced or used commercially without our written permission.

Designs and drawings prepared for your interior project are licensed to you only for that project. They remain our intellectual property and may not be shared with other makers.

12. Reviews and content you share

By posting reviews, photos or feedback, you allow us to use, edit for length and publish them in any medium, free of charge. We photograph completed installations for our portfolio only with your permission, and never show your personal details. You can ask us to remove your content at any time.

13. Third-party services

Payment gateways, banks, EMI providers, logistics partners and linked websites are run by third parties under their own terms. We are not responsible for their services, but we will help you raise issues with them.

14. Limitation of liability

To the extent permitted by law, our total liability for any claim is limited to the invoice value of the Product concerned.

We are not liable for indirect or consequential loss, including loss of profit, business or use.

Nothing in these Terms limits liability that cannot be limited under Indian law, including your rights under the Consumer Protection Act, 2019.

15. Indemnity

You agree to compensate us for losses and legal costs caused by your fraud, misuse of the website, or breach of these Terms.

16. Force majeure

We are not liable for delay or failure caused by events beyond our reasonable control. These include natural disasters, epidemics, fire, floods, strikes, transport disruption, shortages of materials, and government action.

17. Governing law and disputes

These Terms are governed by the laws of India. Please first raise any dispute with our Grievance Officer, so we can try to resolve it.

Subject to applicable consumer protection law, all disputes are subject to Jodhpur jurisdiction only, and the courts at Jodhpur, Rajasthan have exclusive jurisdiction.

18. General

Amendments: We may update these Terms. The version on the website when you place an order applies to that order, unless the law requires otherwise.

Waiver: A waiver by us applies only if it is in writing, and only to that instance.

Severability: If any clause is found unenforceable, the rest of the Terms remain in force.

Entire agreement: These Terms, the policies on this page, your Order Confirmation and any signed quotation form the whole agreement. If they conflict, the signed quotation or Order Confirmation prevails.

Order of documents: If this page conflicts with a statement by a salesperson or on social media, this page prevails unless the statement is confirmed in writing by us.
